Victim 2 Comes Forward and Intends to Sue Penn State

A month after the verdict in the Jerry Sandusky criminal trial, Victim 2 has been identified and intends to sue Penn State.

Until now, Victim 2 had been one of the two unidentified victims mentioned in the grand jury report, Victim 8 being the other. While Sandusky was “not guilty” involving the “involuntary deviate sexual intercourse” charge related to Victim 2, the February 2001 Lasch Building shower incident witnessed by then graduate assistant Mike McQueary became one of the most publicized aspects of the case due to the connection with several Penn State administrators.

After a thorough investigation, Victim 2’s legal team concludes that he “suffered extensive sexual abuse over many years” before and after the 2001 shower incident. The full statement in which attorneys criticize Penn State officials can be found below:

To protect our client’s privacy and in response to several recent media inquiries, we confirm that our legal team, which includes Joel Feller and Matt Casey of the Philadelphia law firm of Ross Feller Casey, LLP, and State College-based attorneys Justine Andronici and Andrew Shubin, represents the person identified as Victim 2.

Our client suffered extensive sexual abuse over many years both before and after the 2001 incident Michael McQueary witnessed in the Penn State Lasch building shower. Penn State has now admitted and there is no longer any question that its top officials could have and should have prevented these acts. Jerry Sandusky’s abuse of Victim 2 and other children is a direct result of a conspiracy to conceal Sandusky’s conduct and the decisions by top Penn State officials that facilitated and enabled his access to victims. We intend to file a civil lawsuit against Penn State University and others and to hold them accountable for the egregious and reckless conduct that facilitated the horrific abuse our client suffered.

Our client has to live the rest of his life not only dealing with the effects of Sandusky’s childhood sexual abuse, but also with the knowledge that many powerful adults, including those at the highest levels of Penn State, put their own interests and the interests of a child predator above their legal obligations to protect him.

We have conducted an extensive investigation and gathered overwhelming evidence regarding the details of the abuse he suffered. This evidence includes numerous voicemails left by Sandusky in the fall of 2011 as the likelihood of his indictment became apparent. Today, we are releasing two of those voicemails. As these messages indicate, Sandusky was attempting to exert control over our client even as his arrest for child sexual abuse became imminent. Due to the sensitive nature of the ongoing criminal and civil cases, we will not make additional comments at this time.

Our legal team also represents multiple other Sandusky sexual abuse victims including, but not limited to, those referred to as Victim 3, Victim 7 and Victim 10.

In both of the September 2011 voicemails left by Sandusky, both messages end with “love ya” and one of them invites Victim 2 to a Penn State Football game. The voicemail messages can be viewed here and here.
