Judge Cleland Dismisses Sandusky’s Motions for a Retrial

Three weeks after Jerry Sandusky’s defense team argued for a new trial, Judge John Cleland denied all post-sentence motions.

Joe Amendola, Sandusky’s lead attorney, has long argued that he and his colleagues didn’t have enough time to prepare for the June trial after his requests for delays were repeatedly struck down. But at the January 10th hearing in Bellefonte, Amendola admitted that he has not found anything in the six months since trial that he wish he had had before the trial began.

In his ruling, Cleland said:

Based on the trial counsel’s testimony it has been clearly established the defense is not bale to prove any actual prejudice flowed from the court’s denial of the continuance motions. While the volume of discovery produced might have been “vast,” as the defense characterizes it, a post-trial review of the material has identified that nothing would have changed the defense trial strategy or would have been useful in advancing the defendant’s defense.

Jerry Sandusky, now 69 years old, is currently serving a 30-60 year sentence at Greene State Prison.
