AG Kane Ousts Judge Behind Sandusky Grand Jury

On Monday, the Philadelphia Inquirer revealed that state Attorney General Kathleen Kane succeeded in removing Barry Feudale as supervising judge of grand jury investigations. In this capacity, Feudale oversaw the investigation that led to indictments against Jerry Sandusky.

In April, Kane asked the state Supreme Court to remove Feudale because “the judge was no longer fit to run a grand jury.” She argued that Feudale belittled her and her immediate predecessor, Linda Kelly. Kane and Kelly were the first female Attorneys General in Pennsylvania since 1961. In an email to a prosecutor involved in the Sandusky investigation, Feudale called Kane’s investigation into Tom Corbett’s handling of the Sandusky Scandal “PATENT in its POLITICAL intent.” Kane also accused Feudale of brandishing a knife in her office.

In May, the Supreme Court removed Judge Feudale as the supervisor of grand juries.

Although Feudale would not comment on the nature of investigations, but offered these remarks about the current Attorney General. “Kane is a politician first, second, and third, and perhaps an AG. . . fourth and fifth.” Feudale also criticized the lethargic pace of the Commonwealth’s case against Tim Curley, Gary Schultz, and Graham Spanier.

Kathleen Kane, a Democrat, won the Office of Attorney General in 2012. On her platform, she promised to investigate Tom Corbett’s lengthy investigation over allegations that Jerry Sandusky committed sex crimes.
