Student Charged With Felony After Allegedly Filming Himself Rape A Woman

A man was charged with felony rape after he allegedly filmed himself having sexual intercourse with an unconscious woman, as first reported by The Daily Collegian. Seung Shin, an international student according to police documents, was arraigned Friday and is now facing multiple first and second-degree felonies and misdemeanors.

State College Police responded to a Plaza Drive apartment on Friday, April 10 when the victim’s roommate called and said a man filmed himself having unconsensual sex with her roommate. When police arrived, Shin and the two females were all still in the apartment.

Police documents that The Daily Collegian refer to indicate that the alleged victim was out at a party and returned home intoxicated where she soon fell asleep. The female says she woke up later to find Shin having sex with her and her undergarments and pants on the ground. The female reported that she tried to make a noise but Shin quieted her and kissed her so her roommate wouldn’t hear.

Police documents also report that the female noticed Shin was holding a cell phone, but when she questioned him and attempted to take the phone, he would not let her. At which point the female ran into another room and both her and her roommate demanded that Shin gave them the phone or they would call the police. Shin asked they refrain because he is an international student.

When the police arrived, Shin told them, “I don’t want to say that she consented, but she didn’t say no,” according to The Daily Collegian. Though Shin admitted he didn’t have permission to film or photograph the two having sex, police found two photos of the female half-dressed as well as two videos of Shin having intercourse with the female who, according to police documents, appeared unresponsive and was moaning in a “painful manner.”

Shin, who is listed as a student in the Penn State directory, was charged with a first-degree felony for rape of an unconscious victim, second-degree felony of sexual assault, second-degree misdemeanor of indecent assault without the consent of the other, first-degree misdemeanor of indecent assault of an unconscious person, and a second-degree misdemeanor of invasion of privacy.

Shin’s bail is set at $500,000 and there is a preliminary hearing scheduled for Wednesday, April 20.
