Former Penn State Student Accused Of Raping Unconscious Woman

A former Penn State student was charged on Tuesday for allegedly raping another student while she was unconscious in her dorm room last August.

According to a criminal complaint filed by Penn State police, Brian J. Loeper, 19, of Glen Mills, walked the woman and her roommate back from a party on campus to their dorm room in Earle Hall at about 10:35 p.m. on Aug. 26. Loeper said he would care for the woman, who was intoxicated, while the roommate went to another party, police wrote.

The roommate returned at 3:49 a.m. to find Loeper awake in bed next to the woman, who was asleep.

Loeper allegedly admitted to the woman in a text message the following day that he engaged in intercourse with her.

A search of Loeper’s phone yielded a text message exchange with the woman discussing her being unable to recall what occurred that night and his “acknowledgement of the rape,” police wrote.

The search allegedly found a text message conversation in which Loeper expressed concern that the university had issued a Timely Warning for a rape that took place “at the exact time and day.”

Loeper also searched the Internet for terms including “sexual assault sentencings,” “sexual assault charges in PA” and “Are you allowed to stay on campus after a sexual assault,” according to the complaint.

He was expelled from the university after an administrative investigation and hearing conducted by Penn State’s Office of Student Conduct and Office of Sexual Misconduct Prevention and Response.

Loeper is charged with felony counts of rape of an unconscious victim, sexual assault and aggravated indecent assault and a misdemeanor count of indecent assault.

He was arraigned by District Judge Casey McClain, who set unsecured bail at $50,000.

A preliminary hearing is scheduled for June 22.
